color: #003366;\"><b><strong><u>7 &#8211; REMUNERATION OF BILLY STAYS<\/u><\/strong><\/b><\/span><\/p><p style=\"font-weight: 400;\"><b><strong>\u00a0<\/strong><\/b><\/p><p style=\"font-weight: 400;\">The remuneration of\u00a0<b><strong>BILLY<\/strong><\/b>\u00a0<b><strong>STAYSS<\/strong><\/b>\u00a0will be in the form of a commission on the total amount Excluding Taxes of the price applied to each operation.<\/p><p style=\"font-weight: 400;\">The rate of the commission is equivalent to 15% of the total price of the stay, the amount to be deducted from the price by\u00a0<b><strong>BILLY<\/strong><\/b>\u00a0<b><strong>STAYSS<\/strong><\/b>, and the balance will be transferred to\u00a0<b><strong>THE OWNER OF THE PROPERTY<\/strong><\/b>\u00a0after\u00a0<b><strong>24 hours<\/strong><\/b>\u00a0of the date scheduled for the arrival of the\u00a0<b><strong>CUSTOMER<\/strong><\/b>.<\/p><p style=\"font-weight: 400;\"><span style=\"font-size: 18pt; color: #003366;\"><b><strong><u>8 &#8211; CUSTOMER CLAIM AND REFUND<\/u><\/strong><\/b><\/span><\/p><p style=\"font-weight: 400;\">The claims are based on 3 cases:<\/p><ol><li style=\"font-weight: 400;\">Unilateral annulment by\u00a0<b><strong>THE OWNER<\/strong><\/b>\u00a0<b><strong>OF THE PROPERTY<\/strong><\/b>\u00a0of a confirmed booking, shortly before the date scheduled for the stay.<\/li><li style=\"font-weight: 400;\">Great difference between the description of the property on the Website and the reality<\/li><li style=\"font-weight: 400;\">A breakdown in one of the equipment necessary for the stay, confusion in matters of security, or problem of cleanliness of the property object of the lease.<\/li><\/ol><p style=\"font-weight: 400;\">In each of the following cases,\u00a0<b><strong>BILLY<\/strong><\/b>\u00a0<b><strong>STAYSS<\/strong><\/b>\u00a0undertakes to remedy the claim immediately, or to have\u00a0<b><strong>THE CUSTOMER<\/strong><\/b>\u00a0refundd, at least the amount he has committed to make his booking, and this, within a maximum of 45 days<\/p><p style=\"font-weight: 400;\">The assessment of the claim lies exclusively with\u00a0<b><strong>BILLY<\/strong><\/b>\u00a0<b><strong>STAYSS<\/strong><\/b>\u00a0and is binding on the\u00a0<b><strong>CUSTOMER.<\/strong><\/b><\/p><p style=\"font-weight: 400;\"><b><strong><em><u>The claim requires the following conditions<\/u><\/em><\/strong><\/b>:<\/p><p style=\"font-weight: 400;\"><b><strong>&#8211;<\/strong><\/b>\u00a0It must be raised by the person who made the booking.<\/p><p style=\"font-weight: 400;\"><b><strong>&#8211;<\/strong><\/b>\u00a0It must be sent in writing or by telephone to\u00a0<b><strong>BILLY<\/strong><\/b>\u00a0<b><strong>STAYSS<\/strong><\/b>, no later than 24 h after the beginning of the stay.<\/p><p style=\"font-weight: 400;\"><b><strong>&#8211;<\/strong><\/b>\u00a0It must not be the direct or indirect deed or fault of the claimant.<\/p><p style=\"font-weight: 400;\"><span style=\"font-size: 18pt; color: #003366;\"><b><strong><u>9 &#8211; OBLIGATIONS OF THE OWNER OF THE PROPERTY<\/u><\/strong><\/b><\/span><\/p><p style=\"font-weight: 400;\">The owner must ensure that the property to be leased via\u00a0<b><strong>BILLY<\/strong><\/b>\u00a0<b><strong>STAYSS<\/strong><\/b>\u00a0meet minimum standards of quality.<\/p><p style=\"font-weight: 400;\">The information displayed on the Website must be accurate without being confusing.<\/p><p style=\"font-weight: 400;\">During the customer&rsquo;s stay\u00a0<b><strong>THE OWNER<\/strong><\/b>\u00a0<b><strong>OF THE PROPERTY<\/strong><\/b>\u00a0must be available or be represented by an available person, in order to try to resolve any claims.<\/p><p style=\"font-weight: 400;\">In case of a claim which had no effect,\u00a0<b><strong>BILLY<\/strong><\/b>\u00a0<b><strong>STAYSS,<\/strong><\/b>\u00a0shall either refund\u00a0<b><strong>THE CUSTOMER<\/strong><\/b>\u00a0on the full price he paid, or transfer him to another similar accommodation, dependent on\u00a0<b><strong>THE OWNER<\/strong><\/b>\u00a0<b><strong>OF THE PROPERTY<\/strong><\/b>\u00a0to refund\u00a0<b><strong>BILLY<\/strong><\/b>\u00a0<b><strong>STAYSS<\/strong><\/b>\u00a0for the refunded amount or the cost of relocating\u00a0<b><strong>THE CUSTOMER<\/strong><\/b>\u00a0to another facility.<\/p><p style=\"font-weight: 400;\">The\u00a0<b><strong>CUSTOMER&rsquo;s<\/strong><\/b>\u00a0claim, takes precedence over the cancellation conditions of\u00a0<b><strong>THE OWNER F THE PROPERTY.<\/strong><\/b>\u00a0The latter is obliged in case of claim, to act immediately to remedy it. Where the claim is contested by\u00a0<b><strong>THE OWNER<\/strong><\/b>\u00a0<b><strong>OF THE PROPERTY<\/strong><\/b>, the latter must send his explanations to\u00a0<b><strong>BILLY<\/strong><\/b>\u00a0<b><strong>STAYS<\/strong><\/b>, in writing, possibly with photos that support the arguments produced by him.<\/p><ol><li style=\"font-weight: 400;\">a)<em><u>Announcements posted by<\/u><\/em><b><strong><em><u>THE OWNERS<\/u><\/em><\/strong><\/b>\u00a0<b><strong><em><u>OF THE PROPERTY<\/u><\/em><\/strong><\/b>: The announcement posted by\u00a0<b><strong>THE OWNER OF THE PROPERTY<\/strong><\/b>\u00a0leased on the Website, shall include accurate and complete information, namely the description of the property, dates of availability and any other specificity.\u00a0<b><strong>THE OWNER OF THE PROPERTY<\/strong><\/b>\u00a0is required to update his announcements permanently. It may be required by\u00a0<b><strong>BILLY<\/strong><\/b>\u00a0<b><strong>STAYS<\/strong><\/b>\u00a0that the photos and video of the announcements be of a precise format, a precise resolution or a precise size.<\/li><\/ol><p style=\"font-weight: 400;\">The announcement posted by the owner represents an offer ; the booking of the\u00a0<b><strong>CUSTOMER<\/strong><\/b>\u00a0represents an acceptance of the offer, the acknowledgment of receipt of this booking by\u00a0<b><strong>THE OWNER<\/strong><\/b>\u00a0<b><strong>OF<\/strong><\/b>\u00a0<b><strong>THE PROPERTY<\/strong><\/b>\u00a0shall constitute an electronic contract between the latter\u00a0<b><strong>and<\/strong><\/b>\u00a0<b><strong>THE CUSTOMER<\/strong><\/b>, which will be governed by the provisions of\u00a0<em><u>the<\/u><\/em><u>\u00a0<em>Moroccan<\/em>\u00a0<em>law<\/em>\u00a0<em>No.<\/em>\u00a0<em>53-05 on the electronic exchange of legal data.<\/em><\/u><\/p><p style=\"font-weight: 400;\"><b><strong>THE OWNER<\/strong><\/b>\u00a0<b><strong>OF<\/strong><\/b>\u00a0<b><strong>THE PROPERTY<\/strong><\/b>\u00a0may require a security deposit from\u00a0<b><strong>THE<\/strong><\/b>\u00a0<b><strong>CUSTOMER<\/strong><\/b>. It can in no case be requested from the\u00a0<b><strong>CUSTOMER<\/strong><\/b>\u00a0after booking.<\/p><p style=\"font-weight: 400;\">By publishing his announcement for leasing of his property,\u00a0<b><strong>THE OWNER<\/strong><\/b>\u00a0<b><strong>OF THE PROPERTY,<\/strong><\/b>\u00a0certifies that this lease is not in contradiction with a law, a regulation or an agreement of which he is a part.<\/p><p style=\"font-weight: 400;\"><em>Conditions of the announcement<\/em>: The booking conditions contained in the announcement published by\u00a0<b><strong>THE OWNER OF THE PROPERTY<\/strong><\/b>\u00a0must be in accordance with the GCOS. None of these conditions must be in contradiction with the present GCOS.<\/p><ol><li style=\"font-weight: 400;\">b)<u>Pricing<\/u>:<b><strong>THE OWNER OF THE PROPERTY<\/strong><\/b>\u00a0is the sole responsible for pricing. Once the booking is made by the\u00a0<b><strong>CUSTOMER<\/strong><\/b>, no additional price can be asked.<\/li><li style=\"font-weight: 400;\">c)<u>Insurance<\/u>: THE OWNER OF THE PROPERTY is required to obtain an insurance adapted to the services he offers.<\/li><\/ol><p style=\"font-weight: 400;\"><span style=\"font-size: 18pt; color: #003366;\"><b><strong><u>10 &#8211; CUSTOMER OBLIGATIONS:<\/u><\/strong><\/b><\/span><\/p><p style=\"font-weight: 400;\"><b><strong>THE CUSTOMER<\/strong><\/b>\u00a0can make a booking by following the booking procedure indicated on the Website. The confirmation of this booking by\u00a0<b><strong>THE OWNER<\/strong><\/b>\u00a0<b><strong>OF<\/strong><\/b>\u00a0<b><strong>THE PROPERTY<\/strong><\/b>\u00a0is considered as a conclusion of a contract under which\u00a0<b><strong>THE CUSTOMER<\/strong><\/b>\u00a0and\u00a0<b><strong>THE OWNER<\/strong><\/b>\u00a0<b><strong>OF THE PROPERTY<\/strong><\/b>\u00a0are mutually committed.<\/p><p style=\"font-weight: 400;\"><b><strong>THE CUSTOMER<\/strong><\/b>\u00a0must comply with all the conditions required by\u00a0<b><strong>THE OWNER<\/strong><\/b>\u00a0<b><strong>OF<\/strong><\/b>\u00a0<b><strong>THE PROPERTY<\/strong><\/b>. In the case of a\u00a0<b><strong>CUSTOMER<\/strong><\/b>\u00a0booking on behalf of another person, the latter must comply with the said conditions.<\/p><p style=\"font-weight: 400;\">During the stay of the\u00a0<b><strong>CUSTOMER<\/strong><\/b>, and for security reasons,\u00a0<b><strong>THE OWNER<\/strong><\/b>\u00a0<b><strong>OF<\/strong><\/b>\u00a0<b><strong>THE PROPERTY<\/strong><\/b>\u00a0retains the right to access his property.<\/p><p style=\"font-weight: 400;\"><b><strong>THE CUSTOMER<\/strong><\/b>\u00a0agrees to leave the accommodation, at the time previously agreed with\u00a0<b><strong>THE OWNER<\/strong><\/b>\u00a0<b><strong>OF<\/strong><\/b>\u00a0<b><strong>THE PROPERTY<\/strong><\/b>. Any overrun will entitle\u00a0<b><strong>THE<\/strong><\/b>\u00a0<b><strong>OWNER OF THE PROPERTY<\/strong><\/b>\u00a0to proceed to the eviction\u00a0<b><strong>of the CUSTOMER<\/strong><\/b>\u00a0by any means consistent with the applicable laws. Additional fees will be billed to the CUSTOMER for his overrun, to which he will be indebted to\u00a0<b><strong>THE<\/strong><\/b>\u00a0<b><strong>OWNER<\/strong><\/b>\u00a0<b><strong>OF THE PROPERTY<\/strong><\/b>. These costs cannot be less than twice the average price of the night, and this as compensation for\u00a0<b><strong>THE<\/strong><\/b>\u00a0<b><strong>OWNER OF THE PROPERTY<\/strong><\/b>. One hour overrun is considered 24 hours (one night).<\/p><p style=\"font-weight: 400;\"><b><strong>THE OWNER<\/strong><\/b>\u00a0<b><strong>OF<\/strong><\/b>\u00a0<b><strong>THE PROPERTY<\/strong><\/b>\u00a0may require, as a condition of booking, a security deposit, which will be, at the end of the stay, returned to the\u00a0<b><strong>CUSTOMER<\/strong><\/b>, or cashed by\u00a0<b><strong>THE OWNER<\/strong><\/b>\u00a0<b><strong>OF<\/strong><\/b>\u00a0<b><strong>THE PROPERTY<\/strong><\/b>, totally or partially as excess costs.<\/p><p style=\"font-weight: 400;\"><span style=\"font-size: 18pt; color: #003366;\"><b><strong><u>11 &#8211; CANCELLATION OR MODIFICATION OF BOOKING:<\/u><\/strong><\/b><\/span><\/p><p style=\"font-weight: 400;\">A confirmed booking may be subject to cancellation or modification by the\u00a0<b><strong>CUSTOMER<\/strong><\/b>\u00a0or the\u00a0<b><strong>OWNER OF THE PROPERTY<\/strong><\/b>. This change or cancellation may result in a change or cancellation fee, depending on the terms of the announcement posted on\u00a0<u>www.billystays.com<\/u>.
